The NDAA Repeals More Rights

Little by little, in the name of fighting terrorism, our Bill of Rights is being repealed. The 4th Amendment has been rendered toothless by the PATRIOT Act. No more can we truly feel secure in our persons, houses, papers and effects when now there is an exception that fits nearly any excuse for our government to search and seize our property. Of course, the vast majority of Americans may say, "I'm not a terrorist so I have no reason to worry." However, innocent people are wrongly accused all the time. The Bill of Rights is there precisely because the founders wanted to set a very high bar for the government to overcome in order to deprive an individual of life or liberty. To lower that bar is to endanger everyone. When the bar is low enough to include political enemies, our descent into totalitarianism is virtually assured.

The PATRIOT Act, as bad is its violation of the 4th Amendment, was just one step down the slippery slope. The recently passed National Defense Authorization Act (NDAA) continues that slip toward tyranny and, in fact, accelerates it significantly. The main section of concern, Section 1021 of the NDAA Conference Report, does to the 5th Amendment what the PATRIOT Act does to the 4th. The 5th Amendment is about much more than the right to remain silent in the face of government questioning. It contains very basic and very critical stipulations about due process of law. The government cannot imprison a person for no reason and with no evidence presented or access to legal counsel.

The dangers in the NDAA are its alarmingly vague, undefined criteria for who can be indefinitely detained by the US government without trial. It is now no longer limited to members of al Qaeda or the Taliban, but anyone accused of "substantially supporting" such groups or "associated forces." How closely associated? And what constitutes "substantial" support? What if it was discovered that someone who committed a terrorist act was once involved with a charity? Or supported a political candidate? Are all donors of that charity or supporters of that candidate now suspect, and subject to indefinite detainment? Is that charity now an associated force?

Additionally, this legislation codifies in law for the first time authority to detain Americans that has to this point only been claimed by President Obama. According to subsection (e) of section 1021, "[n]othing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States." This means the president's widely expanded view of his own authority to detain Americans indefinitely even on American soil is for the first time in this legislation codified in law. That should chill all of us to our cores.

The Bill of Rights has no exemptions for "really bad people" or terrorists or even non-citizens. It is a key check on government power against any person. That is not a weakness in our legal system; it is the very strength of our legal system. The NDAA attempts to justify abridging the bill of rights on the theory that rights are suspended in a time of war, and the entire Unites States is a battlefield in the War on Terror. This is a very dangerous development indeed. Beware.

I think the NDAA is evidence that the net reformation is having an effect as is the proposed SOPA---sort of like trying to close the barn door after the horses are already out!

Many discussions about the NDAA and there are no any actions against it in the US Congress. The same is going on with TSA. Nothing more than individual complaints.

It appears that people are too stupid and nobody cares.

Hi Dotti. Did you get your chickens yet? Did you ever hear the ruckus in a hen house when a fox gets in? This made me laugh, as does memories of that commotion. No hen would sit calmly by and continue laying eggs! Such cackling and wing flapping! I refuse (so far) to be drawn into the street in protest because I know the outcome before hand. It will be manipulated. But this is one thing that would bring me out with a broom. Clean house indeed!!! Go Ron Paul-2012!

NOTE / The following are some key tidbits to the iceburg which tend to make me feel that indeed treason against the american constitution is a high priority with the object to bring the USA down. Indeed, it may well be that the USA was an early experiment by Freemasons and such secret societies with the object eventually to create this very New World Order which it now stands a problem for... but obviously to suceed this domino must fall! The freedom it first set out with may not have been intended as we understand, but for only a certain class of educated people... however, the rational "anti christian" freethinking has in fact back fired and some of the very ideas it put forth and have proved a bit too good for humanity, thus a bit too hard for an elite class of people wishing to dominate humanity. The structure of that democracy was in fact to work grass root upwards; which means local governments sending delegates to state governments to put forth local needs and interests... and state governments delegating to national ones. What has rather happened is people gained a degree of freedom; then starting with the creation of the Federal Reserve Bank... these freedom lost ground. Income taxes and inflation came into being. The real issue of Ron Paul's camp (all though if there is a rat in this... it is the idea of a gold standard and Ron is either a wolf in sheeps clothing pandering to all but that... or has missed this point of fact... or has some other idea to explain this : i.e. where is the gold that would serve as the American people's gold after it has likely been being stolen by these banksters for at least 100 years now... which has escaped me) is the destruction of the Federal Reserve Bank and the preservation of the very thing that holds the USA as both unique and sovereign : the Constitution. Since JFK's magic bullet... this document has been watered down and dragged though the mud by just about every puppet that has been bought and paid for into the White House... as they have well understood the message of the high profile Magic Bullet. It meant : tow the line or get out... and don't worry, we'll give you the exit ticket. Today they are coming out in the open speaking treason against the constitution and have engineered events to scare the people into thinking not far off the lines of : "hey... it's good my phone can be tapped... what if I am a terrorist?" and hey... "It's good they are building FEMA detention camps... and that they can arrest and hold me... I could be a terrorist!" Of course... people do not think that they themselves are such... but the mind control scare propaganda is not far off from that point. The idea that 9/11 could have been an inside job is the stuff of far flung conspiracy theorys... and that is not the case... there is no conspiracy... this stuff is in plain site for all to see : business as usual... and that business is to take over the entire world. And should too... but SO SHOULD THE OTHERS !)... so "give peace a chance" may not, sadly, be the answer! And if that sounds crazy... just go back and listen to promises made by incumbent candidates "read my lips... no new taxes" and so on... Do these people keep them? Not often, no. Either they have no real power, or they are liars, or both.
Now : Last but not least... in response to the heroic deep thinking of Ms. Rabinowitz of the Wall to Wall New World Order run Street Journal... (and Hey! Didn't make this stuff up... it is from the horses mouths and wide open for the sleepy public to see for themselves if they'd just ever skip a beer and a football match long enough to look !) What does the following statement imply?! :

Gorbachev and the liberal Russians made no effort to save the problem-plagued home of world Communism. They simply allowed Russia to succumb to the many injuries inflicted upon itself and upon the far reaches of the Soviet empire, as a result of its "command economy." It seemed as though their real allegiances were with the West. Even today, Gorbachev is singing loudly that Putin needs to surrender now, without even trying to correct the political and economic shortcomings that are motivating people to take to the streets. Against this belief, we have the imaginings of the conspiracy theorists, who see a plot in every move. Their explanation suggested that the USSR's crumbling was a sinister sort of "judo move" by the Gorbachev and the Communists, to turn the tables on the Americans, buying time to recover what had been lost. If that was really the secret plan by the "powers that be," then why have they waited so long to make the next move that would put Russia on top? In that time, the US has merely stumbled, while the USSR disappeared. Perhaps the US was saved from itself by the brilliant CIA plan to create a new artificial enemy--"Islamist terror."

I wish I could agree. Unfortunately, there are too many foxes in the henhouse. The hens cannot get them out. Most of the hens are too busy laying eggs to even care--as long as the fox is not after them, they remain oblivious. Sorry. Sad, but true.

Hm-mm ... the blow back would be severe in our view. There are millions of Ron Paul supporters and they are vocal. Smearing is the preferable mechanism here, in our humble view. That's why it's being used ...

Good try Ekim... but as I am sure you realize Ron Paul IS NOT alone! He has hundreds of thousands of supporters. I certainly hope nothing happens to him, but standing up for your convictions and against tyranny is in the American core. If RP were harmed, there would be such outrage by the American public, that no stone would be left unturned, no lead not followed, and no house left uncleaned.

Ron Paul is the answer? Really? No one man can do anything, do you believe that they can? They have about 300 idiots representing the elites, big oil, big money, and corporations, etc. One guy has no chance what so ever, he'd just get the speech "Do you want to end up like Kennedy?... ."

They had already done this for years now, we don't hear about it of course. Take what you want and leave the sheep in the dark. So what do all 275 million Americans do about it? Sit on the Sofa and eat chips and salsa. We the people took the red pill and now have no spine, just look at those Wall Street occupiers, no support just scoffs and looked down upon. Where is our hero's, people or our patriots? Just sit back in your cubical jamming away on that computer thanking God you have a job right? I just don't know any of you anymore. Good Luck...

Yes Thank God for a real hero a real statesman to bad his message wasn't reaching people long ago and perhaps we would't be here today . I just pray ThatD r. Paul will become president Paul ,he is already to me just that he is the only answer to help what was once the greatest country in the world or at least I thought it was , I have had so many disaapointments about a few of our leaders I use to thin Jimmy carter was just picked on and sooooooo sweet oh my god I can see his bohemian grove deEvil just pure evil all of them. And people are just doing nothing, or at least ignoring, if I tell them about th bill to kill americans no judge no charge, no nothing they just look at me and walk away .

I think that every Senator or Representative who voted for this abomination ought to be charged with treason and violation of their oath of office. That would be about 97 of the Senators.
